MindYourBills conditions

• The application MindYourBills is IRC GROUP's property.
• The use of the application MindYourBills is free.
• The user is the only responsible person for the emails he sends with the application. IRC GROUP cannot be held responsible for the contents of emails modified by the user.
• Any fraudulent use of the application MindYourBills will automatically cause the closure of the account, or even possible legal proceedings. 
• INTERNATIONAL RECOVER COMPANY®'s debt collection services are chargeable but not mandatory.

IRC conditions

• INTERNATIONAL RECOVER COMPANY®  is IRC GROUP's out of court debt collection department, in accordance with belgian law of 2012 on debt collection companies. INTERNATIONAL RECOVER COMPANY® also respects the General Data Protection Regulation of 2018.
• When a user decides to entrust an unpaid file to INTERNATIONAL RECOVER COMPANY®, he certifies that these debts are unpaid and accurate and authorizes INTERNATIONAL RECOVER COMPANY® whether to accept a fractioned payment agreement.
• A file consists in a suite of invoices issued once for the same debtor.
• INTERNATIONAL RECOVER COMPANY® undertakes to perform all amiable actions in order to recover as soon as possible the files sent by the customer and will act firm, but so as to reach an amiable settlement of disputes.
• The customer will be invoiced a commission for all recovered amounts, on condition that payments are made to INTERNATIONAL RECOVER COMPANY® - IRC GROUP, its customer or on condition that a debt is canceled following an agreement entered by the customer and the latter's debtor or a third party acting on behalf of the debtor. The commission will be calculated according to the following model:
  • For a payment before the 15th day: 12% of the recovered amount;
  • For a payment after the 15th day: 20% of the recovered amount;
  • The commission will decrease to 12% for received amounts that are in excess of € 2000 and to 6% for recovered amounts that are in excess of € 25.000; An additional commission of 5% from a recovered amount is due for files in which the debtor lives in another country than that of the customer;
  • The minimum rate is € 9,50.
• As long as these remain in accordance with the laws of debtor's country, in addition with the principal to be recovered it will be claimed part or all of the general terms of payment and any legal interests. These increases assumed by the debtor will remain the property of INTERNATIONAL RECOVER COMPANY® – IRC GROUP, except the fixed compensation. In case the general conditions do not mention it otr are no longer in conformity with legislation, € 30,00 will be chargedin case of travel of the agent.
• In case of incomplete contact details,  INTERNATIONAL RECOVER COMPANY® – IRC GROUP reserves the right to charge the costs of obtaining them respecting the General Data Protection Regulation. The price depending on the debtor's country of residence, it will be provided to the customer for prior approval.
• Except the minimum rate which is irrevocably due, no other commission will be claimed in case of non-recovery. When a file is closed and there was no recovery achieved, the statement will indicate the reason for the unsuccessful closure.
• A monthly statement will be send by email for all closed files, with details on amounts collected. The status of current files is accessible 24/7 on our website www.recover.eu. Access is provided on request, for a single flat rate of € 10,00. This monthly statement can also be send by post for a monthly fee of € 5,00 to cover printing ans stamp costs.
• Collected amounts will be transferred to the customer on a monthly basis, after a deduction of taxes and fees owed to INTERNATIONAL RECOVER COMPANY® – IRC GROUP.
• Commissions, file management fees, travel costs, webside access costs and research fees are subject to VAT.
• If a debtor pays the debts directly to the customer, the latter must immediately inform INTERNATIONAL RECOVER COMPANY® – IRC GROUP. If such an action does not take place within 10 days, a maximum file commission will be applied.
• All our prices and fees can be modified by simple email sent to the customer. The new rate will take effect on the first day of the month following the sending of the email.
• All our invoices are payable directly. In case of non-payment on the due date, an interest of 12% per year from the invoice date will be claimed to cover the cost related to the lack of cashflow generated by the late payment. In order to cover the cost of the steps taken before sending for recovery, a conventional and irreducible fixed compensation of 20% with a minimum of € 50,00 becomes due and payable without formal notice. In addition to these costs and interesten, the amount of our invoices may be increased by € 12,50 by reminder made, itself increased by € 30,00 if a agent travels. For any dispute, only the Court of Liège and the Belgian law are competent. Invoices shall be deemed as accepted without reserves. Invoices that are not challenged within 8 days by certified mail will be deemed as having been accepted by the customer.
• The recovery of unpaid invoices is entrusted to INTERNATIONAL RECOVER COMPANY® (a brand validly represented by its parent company, its branches, subsidiaries and franchises situated in Europe and whose contact details are available on www.recover.eu).
  Your personal data which are necessary to recover our debts (contact details: names, addresses, phone, email, etc. and billing information: number, date, amounts payments, etc.) will therefore be kept for the needed period to recover the amounts due. The same personal data may also, for the same purpose and while respecting the criterion of material and temporal necessity, be communicated to all of their subcontractors (call center, debt collection agents, lawyers,...).

GDPR data

IRC GROUP respects the General Data Protection Regulation.

•  Since 1993, we have processed personal data as confidential information. We make every effort to avoid leakage of information.
• We communicate personal data exclusively to our sub-contractors (debt collection agents,...) or lawyers, and we only do so for the successful execution of the debt recovery mission entrusted to us.
• We seek, organize and retain all the private information necessary for the successful execution of the mission entrusted to us.
• The archiving time is strictly necessary for the fulfilment of our mission and for the observance of our regulated and legal obligations.
• If the debt in question is recovered, we systematically suppress personal data within 7 years from the full payment of the debt, in accordance with our legal obligation to store tax information for verification purposes.
• In case of a material impossibility to recover the debt in question (e.g. insolvency) or legal (e.g. final negative decision, decision proving the prescribed nature of the debt,...), we suppress personal data within 1 year from the finding of impossibility of recovery.
• If the assignment entrusted to us is terminated before the recovery of the debt in question, we suppress the personal data after 1 year.
• Until now, we have not experienced any loss of data.
• In the specific case of using this application, the introduced by the user GDPR data are secured and kept until the user destroys them. In no case are they used for marketing purpose nor transmitted to third parties. However when the user chooses to entrust the recovery to INTERNATIONAL RECOVER COMPANY®, the information useful for managing this debt collection is transmitted to him.
